An AI system can be classified as high-risk in two cases:
- Safety components: if the AI system is embedded as a safety component in products covered by existing product legislation or is the product itself. An example is AI-based medical software.
- High-risk use cases: if the AI system is used for a high-risk purpose. These include sectors like education, employment, law enforcement, or migration.
If your AI system falls into these categories, you’ll need to meet strict compliance standards before entering the market. Guidelines for high-risk classification will be published before the rules take effect.
The EU AI Act’s Annex III identifies eight sensitive areas where the use of AI is considered high-risk. Here are a few key examples:
- Critical infrastructures: AI systems used in safety-critical environments like road traffic management or the supply of water, gas, heating, and electricity.

For high-risk AI systems, European harmonised standards will be essential. These standards help businesses comply with the AI Act’s requirements by providing a clear framework for developing trustworthy AI.
- CEN and CENELEC: in May 2023, the European Commission tasked these European standardisation organisations to develop these standards. They are expected to finalise them by April 2025.
- Presumption of Conformity: once published in the official journal, AI systems developed according to these standards will be assumed to comply with the Act’s requirements.

What are the obligations for providers of high-risk AI systems?
If you’re developing or deploying a high-risk AI system, here’s what you need to be prepared for.
- Conformity assessment: before launching in the EU, providers must subject their system to a conformity assessment. This ensures the AI meets the standards for data quality, transparency, human oversight, accuracy, cybersecurity, and robustness.
- Third-party assessments: high-risk AI used in biometric systems, or as safety components in products, must undergo third-party conformity assessments.
- Quality management: providers must implement robust quality and risk management systems to minimise risks throughout the AI system’s life cycle.
- Public database registration: high-risk AI systems used by public authorities will be listed in a public EU database, except for those related to law enforcement or migration which will be stored in a non-public database accessible only to supervisory authorities.
- Post-market monitoring: authorities will regularly audit high-risk systems and facilitate post-market monitoring. Providers must also voluntarily report any serious incidents or breaches related to fundamental rights.
Ensuring compliance from the start is critical. Missing a step could result in your AI system being pulled from the market or subjected to heavy penalties.
How are general-purpose AI Models being regulated?
General-purpose AI models, like large language models or generative AI, can be used in a variety of applications. The EU AI Act introduces specific regulations for these models, particularly when they pose systemic risks.
- Transparency obligations: providers of general-purpose AI models must disclose key information to downstream AI system providers, ensuring transparency and safety.
- Systemic risks: models trained using a total computing power of more than 10^25 FLOPs are considered to pose systemic risks. Providers must assess and mitigate these risks, report serious incidents, and ensure cybersecurity.
